The NEW Legislative Framework28th April 2010 The Department for Business Innovation and Skills (BIS) has the responsibility for coordinating two of the three new elements that make up the New Legislative Framework. These EU measures relating to Community Harmonisation Legislation are sometimes referred to as the ‘Goods Package’. The Goods Package consists of; Regulation on Accreditation and Market Surveillance (RAMS); Decision on a Common Framework for the marketing of products (CE Marking); and a Regulation on Mutual Regulation. The Goods Package will create significant changes that will affect everyone who is currently placing, or going to place, any product onto the market within the member states of the EU. The concept is to harmonise definitions, conformity procedures, rules for affixing the CE mark, as well as to establish frameworks for accreditation and market surveillance. With the New Legislative Framework (NLF) already in place, since the start of January, the NLF will allow the European Commission to implement new Regulations, without the need for each member state to adopt them into the national law of the country. As a result, each product Directive (CE and non-CE marking) will be reviewed and amended, in accordance with the new harmonised approach. Further to this, with the ability to directly implement the new Regulations, it could happen very quickly. With such a major change, we have invited Richard Lawson, Head of Technical Regulation at BIS, to speak to at our next Member’s Meeting on the 20th May 2010.
